Territorial Protocols

DEFINITIONS

1. "Charter member" A body corporate that is the registered owner of the Outward Bound trade mark, name and symbol.

2. "Licensed member" A body corporate that has concluded a non-exclusive licence agreement for the use of the Outward Bound trade mark, name and symbol with The Outward Bound Trust (UK).

3. "Outward Bound School" Either a Charter or a Licensed member approved by Outward Bound International.

PROTOCOLS
Each Outward Bound School is responsible for protecting, monitoring and maintaining the good name, standards and reputation attached to the Outward Bound trademark, name and symbol within its national boundaries as follows:

1. Where an Outward Bound School is considering the establishment or operation of an Outward Bound activity in a country in which there is no Charter or Licensed member it will inform Outward Bound International Inc. to inquire of any possible conflict.

2. Each Outward Bound School understands that inquiries and program opportunities from individuals, groups, companies and other organizations may not recognize boundaries self-imposed by Outward Bound. However, each Outward Bound School supports the concepts of collaboration, mutual assistance, the development of international and/or regional strategic alliances, and the synergistic cross marketing
and program initiatives that can benefit Outward Bound worldwide.

3. No Outward Bound School shall use the Outward Bound trade mark, name and symbol within the national boundaries of another Outward Bound School to promote programs or services, recruit participants for its programs, solicit funds, or manufacture, market, distribute or sell goods, without the advance written permission of the Outward Bound School in the affected territory.

4. Each Outward Bound School recognizes, however, that communications through the media of radio and television broadcasting; international publishing; the Internet; satellite and technologies not yet developed, are capable of crossing, and do cross, national boundaries. Therefore, with respect to the provisions set forth in number 3, each Outward Bound School agrees that:

* It will not intentionally broadcast or otherwise cause any material depicting the Outward Bound trademark, name or symbol to be communicated directly within the national boundaries of another Outward Bound School.

* It will prominently display its national origin in connection with the use of the Outward Bound trademark, name or symbol that are communicated by any of the media described in this paragraph.

* Each Outward Bound School further recognizes that, in some instances, incidental exposure of a communication by means of the media described in this paragraph outside the national boundaries cannot be avoided. Each Outward Bound School agrees to take all reasonable steps to minimize such incidental exposure.
